KokuaOS — Messaging Acceptable Use Policy

The messaging-specific rules that govern SMS, MMS, and other text messages sent through the KokuaOS Platform, by KokuaOS and by every Customer, Service Provider, and Reseller that sends messages using it.

Capitalized terms have the meanings in the KokuaOS Definitions Schedule (kokuaos.com/legal/definitions).

1. Purpose and scope

This Messaging Acceptable Use Policy ("Messaging AUP") states the messaging-specific rules that apply in addition to Section 3.4 of the Acceptable Use Policy (kokuaos.com/legal/aup). It applies to KokuaOS's own messaging programs and to every Customer, Service Provider, Reseller, and downstream Customer that sends SMS, MMS, or other text messages using the Services.

2. Consent and identification

Anyone sending messages through the Services must: obtain the level of consent required for the message being sent, before sending it; identify the actual sending business to the recipient — not KokuaOS — unless KokuaOS is itself the sender; and keep informational/transactional consent and promotional consent separate, each independently opt-in and unchecked by default.

3. Evidence and suppression

Senders must retain evidence of consent where required by law or carrier rule, honor STOP and other recognized opt-out keywords immediately, and maintain a suppression list of opted-out numbers across the applicable program.

4. Prohibited practices

Senders must not: purchase, rent, sell, or transfer messaging consent or lead lists; use purchased or third-party lead lists to send unsolicited messages; send deceptive, fraudulent, harassing, or unlawful messages; use multiple sending numbers or other techniques to evade carrier filtering or enforcement; or send messages to a number after consent for that program has been withdrawn.

5. Compliance obligations

Senders must comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM, carrier and telecommunications-provider requirements (including 10DLC/A2P registration where applicable), and all other applicable federal, state, local, and international law governing the message.

6. Activation and enforcement

"Twilio connected," or an equivalent provider connection, is not equivalent to "messaging approved." Messaging activation requires completed compliance information and an approved or verified registration status for the applicable program. KokuaOS may restrict, suspend, or terminate messaging capability — for a specific number, campaign, AI Employee, or account — where necessary to address suspected spam, fraud, unlawful messaging, excessive complaints, carrier violations, or a threat to the messaging ecosystem, consistent with the enforcement provisions of the Acceptable Use Policy.

7. Downstream responsibility

Each Service Provider, Reseller, and Customer is responsible for the messaging conduct of its own downstream Customers and Authorized Users, as if it were its own, consistent with the Acceptable Use Policy.

8. Relationship to other policies

This Messaging AUP is incorporated into and supplements the Acceptable Use Policy and the SMS Terms and Conditions (kokuaos.com/legal/sms-terms). Breach of this Messaging AUP is a breach of the Agreement.
